Constitutional Law Provisions Towards Disaster Management in Thailand
Abstract
Democracy involves fundamental rights, minimizing social, political, and economic risks governed by legal philosophies. The Thai Constitutional law is epitome of the law system. It governs all sectors including public and private and aims at ensuring fairness, justices and implying with laws. This research explores, understands and analyses the various legal implications upon the business sector in Thailand. The methodology adopted for this research aims at exploring, understanding and analysing the existing legal framework which has a direct effect upon business sector amid disasters. The data collection involved various legal Acts, government reports and publications. To support the government data, several research and online publications have been also analyzed to reach a holistic and comprehensive theoretical model to achieve sustainable future. The findings include the ineffective implementation of Thai laws during disasters in the rural and remote areas, mismanagement of the business sector resulting in several closures. The research provides for a comprehensive discussion and recommendations to enhance sustainability in Thailand amid disasters such as COVID-19 pandemic, floods, droughts, earthquakes and Tsunami. This research could be replicated or adopted in the other developing countries in the Association of Southeast Asian Nations (ASEAN) region. The limitations of this research including the language barrier have been tackled with official English language translations of the Thai Constitution and other legal documentations. The research paves way for future development and growth of the existing legal, business and disaster management scenarios in the developing world.
